GENERAL TERMS AND CONDITIONS

  1. As a consumer, you have legal rights in relation to any services that are not carried out with reasonable skill and care, or if the materials we use are faulty or not as described. Advice about your legal rights is available from your local Citizens' Advice Bureau or Trading Standards office. Nothing in these terms will affect these legal rights which are governed by Scottish Law.

  2. All staff have a right to work without fear of intimidation or abuse.  

  3. All Treehouse and Optimise Health and Fitness etiquette rules will be adhered to.  Failure to do so may result in exclusion from the facility.  PlayPlus Ltd reserves the right to amended these rules to reflect changing circumstances. 

  4. There may be occasions where we have to close all, or part of, the facility of which you are a member. We will do our best to let you know of such closures in advance of them taking place, unless the problem is urgent or an emergency. We will use all commercially reasonable endeavor to ensure that such closures are outside of peak visiting hours and are kept to a minimum, in both duration and frequency. You will not be entitled to a refund of part of, or all of, your membership fees in such circumstances.

  5. PlayPlus Ltd will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under these terms that is caused by any event that is outside of our reasonable control.

  6. Playplus Ltd accepts no liability or responsibility for the contents of links to 3rd party sites. 

  7. Playplus Ltd accepts no liability or responsibility for personal items brought into the facility.

  8. PlayPlus Ltd accepts no liability or responsibility for vehicles, possessions within them, or bikes within the Jamesfield car park.  

  9. The Treehouse and Optimise Health and Fitness are insured with David Miller Insurances. 

PAY IT FORWARD TERMS AND CONDITIONS. 

  1. Any item available to purchase is also available to purchase as a Pay it Forward' gift. 

  2. All purchases will be taken through the official booking/till system and be officially recorded. 

  3. Sessions/items can be redeemed by asking at reception if any items are available.

  4. There will be no end date or expiration on items available. 

  5. No record of the purchaser or recipient will be made, and no reciprocal details given unless specifically requested and permission obtained and officially recorded. 

OPTIMISE HEALTH AND FITNESS MEMBERSHIP TERMS AND CONDITIONS

  1. The membership contract between you and PlayPlus Ltd will commence upon acceptance in the web-based sign up process.

  2. The membership contract will be confirmed by email.

  3. The membership will entitle you to use the facilities as detailed in the given membership taken.

  4. The membership cannot be used by anyone else.

  5. The membership cannot be transferred to anyone else.

  6. Memberships are payable a month in advance therefore the first month’s (or part-month’s pro-rata) membership fee will be taken at time of purchase.

  7. Membership payments will be taken on the 1st of the month by the payment method selected.

  8. Any payments returned unpaid will incur a fee of £12.50 to cover banking charges.

  9. Unpaid memberships will be immediately suspended and access to the gym or classes will be paid for at pay-as-you-go rates.  These may, at our discretion, be re-funded if your membership debt is settled to cover the period of time access was paid for.

  10. Membership payments are not refundable.

  11. Memberships can be cancelled at anytime by cancelling the direct debit at your bank and informing PlayPlus Ltd of the termination.  Your membership will remain active until the last day of the month prior to payment being terminated.

  12. Any changes to membership details will be made clear to PlayPlus Ltd immediately.

  13. PlayPlus Ltd will, with at least one month’s notice, make clear any planned increases to membership prices.  During this period, you will have your usual right to terminate your contract.  If your membership is not terminated the new price will be applied to your direct debit in accordance with the notice given.  

  14. Annual memberships can be cancelled but will incur a fee of 50% of the pro-rata remaining membership.

  15. Money Back Guarantee: As per the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 you are entitled to cancel your membership and receive a full refund of any fees paid within 14 days of completing your membership application form. However, as per regulation 36 of Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, if you select to commence your membership immediately, you agree that if you subsequently cancel your membership within the 14 day period, you will be refunded any monies paid, less an amount for the membership you have already used commencing from the first day after joining.

 

OPTIMISE HEALTH AND FITNESS GENERAL TERMS & CONDITIONS

  1. PlayPlus Ltd will be given the opportunity to respond to any complaints prior to negative reviews being displayed on social media sites.

  2. All members agree to read and sign to indicate their compliance with our health and safety policy detailing the responsibilities of both the member/s and PlayPlus Ltd. 

  3. All members agree to complete at least a basic induction to cover health and safety and safe use of equipment and are further responsible for arranging a more in-depth induction if required. 

  4. Members will adhere to the club opening hours.

  5. Members using the gym must be 16 or older.

  6. “Family” sessions must be attended by at least one adult over 18 who will agree to be responsible for the conduct of the younger participants and their adherence to club etiquette rules that are displayed in the club.

  7. Class attendees agree to arrive before the class begins, allowing time for “set-up” so that classes can begin on time.  Any members who arrive after the official start time of a class must ask at reception/the instructor if it is appropriate to join the class.  Participant agree to respect the decision of the staff.

  8. Class attendees agree to communicate any injuries, pregnancies or need for exercise modifications to reception/instructor.  All staff will treat this information with absolute confidentiality however participants must appreciate that whilst general modifications and advice can be given in private, modified instructions may have to be made aloud during class for your safety.   Please indicate to staff if you do not wish for verbal modifications to be made during class.

  9. Ages for the Born to Move classes may be flexible within reason but only with permission of a member of staff. 

  10. Members agree to comply with club etiquette rules which are displayed in the Club. We may make reasonable changes to these Rules at any time provided that we give you advance notice of the change.

  11. Playplus Ltd will not be liable for the failure to show of any independent class instructor where bookings for the class is taken independently of PlayPlus Ltd.  PlayPlus Ltd are further not responsible for the quality or content of any independent class.        

  12. We may terminate this agreement with immediate effect on notifying you if you are in breach of the Clubs Rules.

  13. To the best of your knowledge and belief you are in good health and not knowingly incapable of engaging in either active or passive exercise and that such exercise would not be detrimental to your health, safety, comfort, well-being or physical condition. Further, that you will advise us immediately should your circumstances change.

OPTIMISE HEALTH AND FITNESS CLASS BOOKING TERMS AND CONDITIONS

  1. Classes are available to book online 6 days prior to the day of the class.

  2. Classes can be booked by non-members but must be paid for in advance. This can be completed online, in person at the club or over the phone. 

  3. No block booking is possible allowing everyone an equal chance to book a class.  Private classes may be an exception to this.

  4. Private classes may require a block-booking commitment and may require payment directly to the instructor/organisation that may or may not be additional to a club membership.   

  5. Please give as much notice as you can if you cannot attend.  This can be done on our web booking system or by phoning the club. 

  6. Multiple non-attendance at booked sessions, and in particular where a class waiting list is in place, may result in booking privileges being removed temporarily or permanently. 

  7. Class reserve spaces will be offered to customers at the top of the list first but will be allocated on a first come, first serve basis.

  8. Anyone remaining on the reserve list and unable to attend a class will be offered a space in the class the following week before general booking is available. 

TREEHOUSE GENERAL TERMS AND CONDITIONS

  1. All children must be  detailed in the log book. Please remember to sign out.

  2. Parents/carers must stay on the premises

  3. Maximum 2-hrs play  at peak times

  4. No shoes permitted and socks must be worn by all– available to buy at reception

  5. No hard or sharp objects allowed in play area

  6. Photographs/videos may be taken ONLY if you child/children are CLEARLY the only ones in the shot

  7. No food or drinks allowed in play area

  8. If using creche, please provide a water bottle labelled with child’s name

  9. Allow 48-hrs after contagious illnesses before using facilities

  10. Please take children to the toilet before play commences

  11. Toilet policy: Pants are Private! We are not permitted to take any child to the toilet. If your child is old enough to safely go on their own, please indicate your consent in the log book with your initials

  12. Parents are responsible for their children's behaviour at all times. Poor behaviour may result in a child being asked to take a break or potentially leave but we do appreciate that the little people are still learning and that being kind, forgiving and tolerant teaches kindness, forgiveness and tolerance.

TREEHOUSE BOOKING TERMS AND CONDITIONS

  1. 50% of our soft play capacity will be available to book, 50% first come, first served basis. 

  2. Spaces in the soft play and creche may be reserved online, paid in advance

  3. Spaces can also be reserved by phoning the club or at reception

  4. Spaces will be held for 30-mins. We will attempt to call you but if there if no reply and then the space will be offered first come, first serve.

  5. Please cancel whenever possible and your session can be postponed or donated to our ‘pay it forward’ scheme. 

TREEHOUSE NEST SUPERVISED PLAY TERMS AND CONDITIONS

  1. All Treehouse staff are PVG checked​ and we adhere to current NSPCC guidelines for child:staff ratios.  

  2. All general Treehouse Terms and Conditions apply. 

  3. Minimum age is 6-months, however, for safety, all children must be able to 'self correct' if they roll over sit unsupported.  

  4. Maximum time in creche is 2hrs

  5. Responsible adult must stay within the building and be contactable by phone or pager system.

  6. Creche etiquette must be adhered to. 

  7. All children must have a water bottle labelled with their name.

  8. Staff are not permitted to give drinks other than water, including milk bottles, or snacks. 

  9. All children should have been taken to the toilet or nappies changed immediately before session starts. 

  10. Staff are not permitted to take children to the toilet or change nappies.

  11. Older children may be allowed to go to the toilet by themselves if your permission is clearly indicated in the sign in book. 

  12. Accompanying adult will be contacted immediately if a child needs to go to the toilet. 

  13. No medications can be administered. 

  14. Staff are not Epi-pen qualified. 

  15. Children must be collected promptly.  A delay in collection after a 1hr session may result in further charges.  A delay in collection after a 2hr session will incur a £20 administration fee for reporting the extended sessions to local authorities as per legal requirements.

  16. Sessions are not refund-able or transferable other than at our discretion in exceptional circumstances. 

TREEHOUSE KIDS PARTIES TERMS AND CONDITIONS

  1. Use of the private function room is £30 per hour and subject to availability.

  2. The Treehouse play area will remain open to other customers unless exclusive use is arranged. 

  3. Light snacks for Children consist of a packet of crisps, a sweet snack bar, a piece of fruit.  Jugs of tap water will be provided. 

  4. Light meals for Children consist of sandwiches and pick 'n' mix salad items as prepared by Jamesfield Restaurant, a packet of crisps and a piece of fruit.  Jugs of tap water will be provided. 

  5. Teas and Coffee's for Adults: 1 drink per person. Order will be taken by staff on the day just prior to serving. 

  6. Light snacks for Adults consist of a packet of crisps, a sweet snack bar, a piece of fruit. 

  7. Light meals for Adults consist of sandwiches and pick 'n' mix salad items as prepared by Jamesfield Restaurant, a packet of crisps and a piece of fruit.  

  8. Private Born to Move Class will be appropriate for the age range of children booked and will be supervised by a member of staff. 

  9. Room Decoration will include wall banners, balloons that can be taken away and table decorations of a generic theme.  Any specific themes must be requested with two weeks' notice, will be accommodated wherever possible, but are not guaranteed.

  10. Invitations Prepared will be with official Treehouse stationary unless otherwise requested.  Any specific themes must be requested two weeks prior to date of required dispatch, will be accommodated wherever possible, but are not guaranteed.  Invitations will be prepared for all named guests using the exact spelling.  Prepared invitations can be collected or posted to a given address for further distribution at an agreed date.

  11. Birthday/Event Cakes.  PlayPlus Ltd work with a number of independent cake makers, subject to availability.  Details of required design should be given with at least two weeks' notice with as much detail as possible to ensure the design is as desired.  Pictures are recommended.  PlayPlus Ltd will not be responsible for the quality of the product and any complaints/refund requests will be made directly with the cake maker. 

  12. Event Photographer: PlayPlus liaise with a number of independent photographers who are subject to availability.  Any photographs in the Treehouse area will be dependent upon how busy the area is as other children must not be captured in any image.  Permission for children in your party to be photographed will be your responsibility and any children who are not allowed to be photographed must be made known to the photographer. 

  13. Eco-responsible Party Bags will contain wooden/paper based toys rather than plastic and a Treehouse themed "Thank you for coming to my party" card.  A slice of party cake can be included if staff are notified. 

  14. Event room must be cleared of all personal belongings after the 1hr session as further classes may be scheduled.

PROMOTION TERMS

  1. PlayPlus Ltd reserves the right to end any promotion without warning at any time.

  2. Any prizes offered by PlayPlus Ltd must be claimed within 21 Days of announcement of the winners. PlayPlus Ltd have 45 days to issue any prize.

  3. Any challenges are subject to fair play and must be carried out as per the instructions detailed in club.

 

GUEST/DAY/FREE PASSES

  1. Guest/Day/Free pass users agree to follow club etiquette rules as detailed throughout the club.    

  2. 1 Guest/Day/Free pass must be presented per person.

  3. Guest/Day/Free passes should be presented at reception prior to use of the facilities.

  4. Guest/Day/Free passes may be subject to an expiry date and, if so, this will be clearly detailed on the pass.

  5. Guest/Day/Free pass customers who wish to use the gym will agree to read and sign to indicate their compliance with our health and safety policy detailing the responsibilities of both the member/s and PlayPlus Ltd and to receive a safety induction prior to using the gym equipment.   A more in-depth induction or writing of a gym programme must be paid as per non-member rates and are subject to availability.

  6. Guest/Day/Free pass customers who wish to use the Treehouse agree to adhere to the 2-hr play time limit and all specific Treehouse terms and conditions. 

  7. Guest/Day passes are non-refundable.

  8. Free passes have no resale value, cannot be exchanged for cash or any other product or service and are non-refundable.
